By accessing and using TorahWiz (“the Service”), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

These Terms and Conditions (“Terms”) govern your use of TorahWiz, an AI-powered Torah learning platform operated by TorahWiz (“we,” “our,” or “us”).

2. Description of Service

TorahWiz is an AI-powered platform that provides Jewish learning assistance, including but not limited to:

• AI-powered responses to Jewish learning questions
• Access to Jewish texts and sources
• Personalized learning experiences
• Voice interaction capabilities (Ultra tier)
• Custom learning plans (Ultra tier)
• Daily Torah digest and study materials

3. User Accounts

3.1 Account Creation

To access certain features of TorahWiz, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

3.2 Account Security

You are responsible for safeguarding the password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3.3 Account Termination

We reserve the right to terminate or suspend your account at any time for violations of these Terms or for any other reason at our sole discretion.

4. Subscription Plans

4.1 Available Plans

TorahWiz offers the following subscription tiers:

• Basic: Free tier with limited daily messages
• Pro: $6.13/month with unlimited messages and advanced features
• Ultra: $15/month with all features including voice mode and custom learning plans

4.2 Payment Terms

Subscription fees are billed in advance on a monthly basis. You authorize us to charge your payment method for all fees incurred. All payments are non-refundable except as required by law.

4.3 Plan Changes

You may upgrade or downgrade your subscription at any time. Changes take effect immediately, and you will be charged the difference for the current billing period.

4.4 Cancellation

You may cancel your subscription at any time. Upon cancellation, you will continue to have access to your current tier until the end of your billing period.

5. Acceptable Use

5.1 Permitted Use

You may use TorahWiz for:

• Personal Jewish learning and study
• Educational purposes
• Research and academic work
• Community and family learning

5.2 Prohibited Use

You may not use TorahWiz to:

• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Harass, abuse, or harm others
• Attempt to gain unauthorized access to our systems
• Use the service for commercial purposes without permission
• Attempt to reverse engineer or copy our technology

6. AI and Content

6.1 AI Responses

TorahWiz uses artificial intelligence to provide responses to your questions. While we strive for accuracy, AI responses should not be considered as definitive halachic rulings or religious authority. Always consult with qualified rabbis for important religious decisions.

6.2 Content Accuracy

We make reasonable efforts to ensure the accuracy of our content, but we do not guarantee that all information is complete, accurate, or up-to-date. TorahWiz is not responsible for any decisions made based on the information provided.

6.3 User Content

You retain ownership of any content you submit to TorahWiz. By submitting content, you grant us a license to use, store, and process your content to provide our services and improve our AI models.

7. Intellectual Property

TorahWiz and its original content, features, and functionality are owned by TorahWiz and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our platform without our express written consent.

8. Privacy and Data

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

By using TorahWiz, you consent to our collection and use of information as described in our Privacy Policy.

9. Disclaimers

TorahWiz is provided “as is” and “as available” without warranties of any kind. We disclaim all warranties, express or implied, including but not limited to:

• Warranties of merchantability and fitness for a particular purpose
• Warranties that the service will be uninterrupted or error-free
• Warranties regarding the accuracy or reliability of AI responses
• Warranties that defects will be corrected

10. Limitation of Liability

In no event shall TorahWiz be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the service.

Our total liability to you for any claims arising from these Terms or your use of the service shall not exceed the amount you paid us in the twelve months preceding the claim.

11. Indemnification

You agree to defend, indemnify, and hold harmless TorahWiz and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from your use of the service or violation of these Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which TorahWiz operates, without regard to its conflict of law provisions.
